Green Card /Asylum Process?

OK, so my Chinese friend has a court date in July that is related to the process of applying for asylum in order to obtain a green card or permanent residency. I am wondering what the typical time frame is between the date of application and the court date? I am trying to figure out how long ago she or her attorney may have made the application.

Also, she has already been in the US for two years, so if she just recently made the application, will it still be considered?

  • It depends on which court the case was filed, and there may be several hearings before a final decision is made. The first step is an interview with a USCIS asylum officer within 43 days of the filing of the petition. A first hearing in front of an immigration judge may take place within six months. Aslyum applicants are supposed to file within one year of arrival. A late application has a high likelihood of beind rejected unless there are extraordinary circumstances.
