can repo services come into private property?

i had a 2011 Honda Civic EX-L. for various reasons i failed to meet the payments for my car note ($380) a month. after 4 months Honda Financial called my house and asked when was i able to pay i told them a date and failed they warned me my car was up for repossession. i came home one day around 5:30pm parked my car in my PRIVATE parking lot as my building offers private and fenced parking. next day around 10;30am i come out to find my vehicle gone with no signs of it being stolen. i called the police and they said they didnt have any record of my car being towed i called honda and they said they had it in a repo impound lot. now my question is; are repo services allowed to come into private property and take the vehicle at night? many people have told me i should file a lawsuit because they have to announce themselves before repossessing the vehicle and i have to willingly take the vehicle out of the private area. however i dont know if this is true and i dont want to waste money on a lawyer for no reason. i need help i dont know what to do

  • Here's my real-world view. The car is gone. They don't have to announce anything. It doesn't matter now how they got it or whether they should not have gone onto private property. Let's say you try to sue them. What are your damages? None. That's the point - you have not been harmed because the car was legally repo'ed.

    Realistically, so what if they were wrong to come into the private lot without permission - that's meaningless now. No court is going to make them give the car back.

    Don't waste a dime on trying to pursue the "car was on private property" argument with a lawyer. It's not going to fly.

  • Yes repo services can come into private property. Repo services can also cross state or country lines if necessary to take back what is rightfully theirs. The people who have told you to file a lawsuit are not the brightest bulbs on the planet. It is completely untrue that the repo person needs to announce themselves before repossessing the vehicle. You stopped paying on the car and no longer have ownership of the Honda Civic. You should consider this a painful learning experience.

  • The Finance Company Doesn't have to tell you that your vehicle is up for Repo. Anytime that you are late even one day they can come & get it. As for Private Property-- if you had the vehicle inside a closed gate, or in a garage then they can not just come in. They got the vehicle out. So that makes me believe that anyone can walk right in. If they opened a gate then you could call the Police, and report it. Also call the better business bureau. Let the bank know that they repo'd it illegally. I doubt they will do anything. Suing them would be hard to prove unless you got a cut lock on your gate.

    Being 4 months behind is a lot. You can try to work something out with them. If you had them money then you probably would've done so. The only other option is to make a settlement for the vehicle if you can come up with the money. I doubt you will be able to get a loan to cover it. You might get a co-signer. Good Luck!

  • They can and do cut locks and even enter garages. There's several repo men shows on tv. If it was llegal, they woudn't be videotaping themsevlves doing it.

  • Yes they can. How else do yo think they would ever get the cars. No one is going to hand over the keys willingly. They do it when you are asleep.
