Is this a generic/ descriptive trademark name?

I am thinking about starting an artist website, selling art and merchandise related to the artworks created by me. I would like to start an LLC and trademark the brand name created based off of my "fictitious business name" mixed with what it is I sell. SO for example "Art by (artist's 'fictitious' name) LLC" would be the trademark desired, but would that be passed? or is that too generic/descriptive and would be denied by USPTO?

  • If you're selling "art" then it would be entirely descriptive to call it "art". Any other combination could be, at at a minimum, "suggestive" and potentially protectable under trademark law, registered or not.

    The relative descriptiveness of the mark, when considered as a WHOLE, would depend upon how distinctive your fictitious name might be. BTW, adding "LLC" at the end of a trademark is pointless, unduly limiting, not to mention bush-league.

    "Art by Joe" is a perfectly good trademark for art.
