In theory, the use of a R4DS is not illegal, because it should be used for playing original and home-made games. Practically it is used also for illegal roms, even if it should not. The R4DS itself is safe and legal, so you can use it.

The R4DS is legal, a better choice is the M3DSreal, actually there are others as well. And putting you own music and videos is fine, so is homebrew games but of course downloading real games and using those isn't.
actually the adapter is legally but it was made for putting music,videos and other things on it,not for games.But as long as you wont sell legend of Zelda:phantom hourglass on r4ds or new super Mario bros or so,no official institutions like police will know about you
Of course there illegal. You would have to buy the official game that was manufactured legally to be actually legal. Downloading the roms for it is also illegal. I even own a M3DS Simply.
obviously, if you download stuff onto it it must be illegal.. because you can download games,music and videos and since your not paying for the games, music or videos it's illegal... stupid question but it earned me and extra 2 points

It depends on the country - it is not illegal in Australia but I think it is in the US.
It is not just for illegal games - there are homebrew games, mp3 music and videos, all legal stuff.
I have a M3DSreal, much better than the R4 I think, BTW.
