consumer credit act. car not as described?

hi i paid 350 with credit card, 2000 by debit card for a car. ive had big problems with car and consumer direct advised me i can also pursue credit card company.

my question is, if credit card company goes in my favour, what happens? do credit card company take the car back and pay me or just pay me what i paid for car and let me keep it? dont wana keep car though.

Update:

There's a secret phrase that turns any credit card into a financial self-defence superhero. "Section 75" laws means your plastic must protect anything you buy over £100 for free, so if there's a problem or the company goes bust you can still get your money back.

  • Pursue them for what?

You made the charges on the credit cards. Credit cards are considered non secured debt. meaning that the debt is between the credit card company and the customer and is not based on any type of collateral.

As long as you make your payments your fine no matter what you do with the car. It's if or when you start missing payments and default on the contract with the credit card company that the problem will come back to haunt you.

    Good luck.

  • Used cars are almost always sold as is with no warranty. You really have no case for a charge back on the credit card or even suing the seller. You should have had a mechanic check out the car BEFORE you bought it.

You will not win any credit card dispute. you authorized the charge and got the car. Credit cards do not play referee.
