Who pays damage to property after a car accident?

So I had an accident almost a year ago, the insurance paid for my car, other insurance paid for my injuries but now all the sudden I get a noticed that I have to pay the property I damage in the accident, so I'm confuse about what insurance covers that damage, any ideas?

  • Hi the cars owners insurance company does that if they don't have insurance then they are personally responsible for any damage which so times means through the local small claims court usually not worth the bother.

  • that's really something you need to give your insurance company a call about... coverage and law varies, but the way i understand it, from what my insurance company told me is: the insurance pays a certain amount ($25k) in my case, anything past that is up to you... there's also a small part you have to pay either way, which is the deductible (few hundred dollars in my case)... i think they also mentioned something about people having the option to bypass the insurance and go after me directly... the proper thing to do would probably be to read over your coverage and contact an attorney or something and get their opinion...

  • You are liable for the property damage. What your policy covers you for no one here can see but usually the car insurance would cover any third party damages

  • Since you haven't made it clear which insurance company paid for the original claim, simply notify YOUR insurance company (the one you had when the accident occurred) of the new property damage claim and allow them to advise you on how to proceed.

  • Usually, the person who is found to be responsible for the accident is the one who has to pay for repairs. That's why people carry liability insurance.

  • Send the claim to the insurance company you were insured with at the time of the accident. They will sort it out.
