how do i sue a company?

we are military living overseas and we sent our 8yr old back to the states to see his grandparents. The airline stuck him in the playroom and forgot to get him. He didnt show up at the final destination....when this happend we called all over and 8 hrs after he landed in detroit he called and said he was in a play room...when could he leave! The airline never contacted myself or my parents to let us know he didnt make his flight!! He ended up spending the night at the airport, on the floor!! But they NEVER called to let us know what was going on!! I would like to sue for breech of contract, because we paid for an escort, and mental anguish, but dont know where to start from all the way over here!!

  • go to the lawyer you have on base. i think you totally have grounds to sue! i can't believe that happened to your child, i'm glad he is back in the safety of you home though! it definatley could've been worse. the airlines should have to pay some sort of retribution and give you a full refund.

  • This must be one of the worst things I have heard for a long time. It is the worst type of pisspoor service from an airline. I presume that your son was sent as an an "UNMR" (unaccompanied minor) and that you completed the required forms etc. As with airlines there is no real body to complain to, then you will need to contact a lawyer. Others have suggested a JAG (militray) lawyer and this would be the most sensible way forward. No doubt they will give advice on what to claim for. I think it would be better in the USA - as you will know the score, as we say in the UK. Frankly, I think it should be more than just a court case and you should seriously think about shameing the airline by "going public" - I know if it was one of my children, I would be off down to the airport and personally confront someone!!

  • What airline did you use?! I worked for a major US airline and there are steps to make sure that NEVER happens. If you are military, get a JAG. Honestly, in those situations the airline would compensate you for the price of the ticket and im sure offer free air travel. But the airlines have a team of lawyers and dont want it getting to the media. In past cases Ive heard of Ive never heard of it getting to court or getting massive compensation. If you really wanted to make a racket you could go to the american media and have the story aired. I dont think there is anything in the airlines contract of carriage about UM's, but go to their website and look it up. Read the piece of paper you signed when you checked the kid in and see what it says as well.

    Are you in Germany? Just curious, I used to live there as well, but for Dow, not the military.

    Anyhow, I would contact a lawyer, state side. There are many ways for you to do this, and even from over there he could still file charges for you in the States.

    I am not a lawyer, but I don't believe you have to be present. He can represent you in court even if you are not there. I am pretty sure thats the case. Anyone else?

  • Since your military, go through your chain of command, to obtain a military attorney (Jag),. I'm sure they will be able to help. Good luck.

  • go to a lawyer. take all the evidence u hav wid u to prove ur part of story he will advice u how to proceed
