Can i Trademark a dissolved NYS Corporation name?

I want to trademark a service name. Lets call it XYZ Tutoring. After searching the NYS COrporations rel="nofollow">http://www.tax.ny.gov/bus/doingbus/tr194…

Now what i want to do is trademark that name, but im afraid to do so because of the following line in that explanation of the reason for dissolution:

A corporation may regain its ability to do business in New York State through the reinstatement process.

•New York Tax Law sets the requirements for reinstatement of New York State corporations (section 203-a) and foreign corporations (section 203-b).

•Once the corporation is reinstated, it re-acquires the same powers, rights, and obligations it had before it was dissolved by proclamation or had its authority to do business annulled.

I would hate to trademark the name and then have the person reinstate that corporation with and have this apply:

"re-acquires the same powers, rights, and obligations it had before it was dissolved by proclamation"

please share your thoughts, i dont want to get Sued
