Autocheck vs Car Fax?

We bought a used car yesterday, and the dealer (?) showed my husband an Autocheck report on the VIN. It was totally clean...no accidents or anything. On the way home, the Check Engine light went on. When he got home, he pulled a Car Fax report, and found that the vehicle had actually been totaled out just 4 months prior! Is it possible for the 2 to be so completely different, or did the dealer somehow pull a different VIN or what?

The dealer is now refusing to work with us saying we bought the car as is. Do we have any rights if the vehicle was completely misrepresented?

  • The car wasn't completely misrepresented. The dealer sold the car based on the information they had and they had a clean AutoCheck report.

    How do you know it wasn't the Carfax report that is wrong?

    This is another clear case of the consumer not doing their homework prior to purchasing a used vehicle. WHY didn't you pull the Carfax BEFORE you bought the car? What good is it going to do you after the fact. WHY didn't you have your mechanic inspect the car prior to the purchase to make sure the car you were buying is worth the money you are spending.

    If the car was truly totaled the title should be listed as REBUILT or SALVAGE. Why didn't your lender research the title before allowing you to borrow money for this car. DId you even check to see if the VIN on the report matched the VIN on the car. I'm guessing no, you didn't.

    So many things you could have done or should have done but didn't do. An educated consumer is the best defense against a bad deal. Not doing your homework is the worst way to buy a car.

    Bottom line, if the title SAYS REBUILT or SALVAGE then you can sue the dealer for misrepresenting the car. Get a copy of the title from the lender.

    But I this anyway if you bought the car as is, you can't change anything anymore.
