The new car i purchased is over heating at higher speeds, and the dealer is on their 3rd attempt to try and fix it. i just purchased the car today. is there anyway i could give back my new used car and reposess my trade in?

There might be a chance, but it is really going to depend on the dealer. However, if they have already sent the title work to the state, then you are out of luck. Once that is done, you truly are an owner, and there isn't really much there can be done.
If they haven't sent off the title work, the dealer MIGHT be willing to do this. The only thing you can do is ask. If you bought the car from me, and this were happening within a day....we would most likely let you back out of the deal. Some dealers, though, aren't as nice unfortunately.
Another option if they won't let you back out of the deal is to see if they have a similar used car on their lot to what you bought. They may not let you just turn in the new car and back out of the deal, but they may let you switch cars. That way, they don't lose a car sale, and you will benefit by getting out of the car that is giving you problems.
As a ways as I recognize, whoever "hits" has the legal responsibility or is "at fault". In different phrases, coverage firms and legislation enforcements standpoint is, "If you're following the entire regulations of the street and defense, there may be in no way any intent to hit some thing." Now, if there used to be ice at the street, that would atleast make matters lean extra for your desire, however I consider you must have a image taken that day of the stretch of street you slid on. That's why they are saying you must constantly have atleast a disposable digital camera for your auto to take a image of an twist of fate and twist of fate scene at the day of the twist of fate, in conjunction with a mobile cell, your coverage knowledge, driving force's license and registration. Hopefully you could have auto coverage so that it will pay despite the fact that it's your fault, or if now not, plenty of peers and household so that it will support you on this time of main issue. There's plenty of different elements to keep in mind: used to be both of the drivers using at the same time impaired, or in a hurry, did both depart the scene of the twist of fate earlier than legislation enforecement arrived, what variety of automobiles have been concerned, did each have auto coverage-dl license-registration-and so forth... So confidently, perhaps there may be different elements which might be for your desire right here. In both case, it is a serious warning call to constantly force adequately and defensively and preserve as a lot house among you and different relocating automobiles or gadgets as feasible, have a seat belt on, and shouldn't have any distractions like being attentive to the radio, consuming, ingesting, speakme on a mobile cell, and so forth... I recognize all this considering the fact that I've been using for years now, and feature handiest been in a couple of injuries. In each and every twist of fate besides one, any one hit me and for a few intent none of them even had a driving force's license!!!! In the twist of fate in which I hit any one, I rear ended any one, identical to you probably did. So for the reason that I "hit", it used to be my fault, although the auto in entrance of me stopped brief and fairly speedy, now not giving me any time to quit. The handiest factor that stored me used to be that the auto I hit left the scene of the twist of fate, and, from what I appreciate, it used to be a few variety of coverage rip-off at the aspect of the opposite driving force.
