Do restaurants need a certain license to deliver food?
My mother plans to take over a failed restaurant and the previous owners gave up because they didn't know how to cook (it was guys) and they were only in it for profit. She has a business plan and one of them requires delivering foods to her current clients. She sells food herself but it was on a client base only. She used to get tickets from the police from not having a business license when delivering the food. Now with the business she hopes those will stop as she will have one and she can say it is just a delivery for the business like the pizza guys do.
Do restaurants need to have a certain license to deliver food? Or is it on a "if you want to offer the service, you can" basis. She wouldn't have the delivery option available to every one (it would be costly, and she would need to hire a driver), her previous clients and possibly new ones she gets along with. She plans to stay at the restaurant, while my aunt makes the deliveries. My aunt would also help out when she is not making deliveries.
Also she plans to deliver the food to her clients in a different county in the state. The restaurant is on the edge of the county we live in, and the one all her clients are in a different county which is like 10 miles down the road. Would this be possible? Or would she need to have a business license in both counties. This came into mind as Dominos/Pizza Hut don't deliver if you live too far. I don't know if it's franchise policy where they have their own territories and can't deliver outside of it, or if they can only deliver so far according to the law.

You should check with your city health department. All food handlers and employees are required to have a Food Handler's Permit from the city health department. Generally, you have to be 16 years old to get one of those.
Also, you would need a City Health Permit from the city to run any kind of food business and you are subject to inspection of your facilities at any time. Every place in town that sells any kind of food product is required to follow those rules. There are certain health rules about the temperatures of all foods and you have to have proper equipment to keep those temperatures. Call your city health inspector and talk to him.
