Legal advice regarding damage to my vehicle in my condo parking garage..?

I live in a condo with assigned/deeded parking spaces. The guy who parks next to me is very old and too weak to control his door. So, his door often bangs up the side of my car when he gets in/out of his vehicle.

I confronted him on this and he admitted fault and apologized but did not offer to pay for the damage. I took the car to a body shop (Maaco, a national company) to get an estimate and there is $2,300 of damage. He blatantly is responsible for every dent on my car because all my dents have red paint from his red car.

I wrote him a letter one week ago and left it on his car with a copy of the estimate. I have not heard back. What legal action can I take against this guy if he doesn't respond? Should I file a police report? Is there any way I can make his insurance company to pay for my damage? Once again, he admitted fault. Any advice is appreciated. Thanks.

  • Contact the local police; file an accident report and run it thru insurance

  • If you did not file the report with the police right after each incident, it is VERY unlikely that any officer will file a delayed report when it's hard to prove that it happened when and as you say. (I wouldn't write it). Contact your insurance company with his information. If you have his insurance company's name give that to your insurance. Otherwise your insurance co will contact him and go from there. You really were too nice to him. If he's been causing all that damage to your car, you should've reported it sooner. You can sue him in civil court too, if his insurance won't do anything due to the delay.

  • The first question I have is, are there camera's in your parking area? If there are, simply get footage of the alleged acts and file suit against the man. If there are not, try sitting in a dark area one day and filming him doing this. If you cannot catch this I am afraid that your word against his is all you have. You can still file suit and explain that the assigned parking puts his car next to yours therefore it could only be his car. Talk to a lawyer. There are some legal aid lawyers if you dont have the money to hire one.

  • Definitely go with your insurance company. Also, is the man having other difficulties with driving? If so, he might be a safety issue. It may be worthwhile checking with the DMV to see what the policy is regarding reporting impaired drivers.
