Now a days employers club GRATUITY as a part of CTC..?

Now a days employers club GRATUITY as a part of CTC, if a employee leaves the company before 5 yrs will the accrued gratuity will be paid back to the employee after deducting tax or shall be only paid after five yrs completion of service..
