Bacterial vaginosis made me go into preterm labor..My drs fault! help?
My son was born at 23 weeks due to an infection called "bacterial vaginosis"..
at 2 months along in my pregnancy I went into the ER becuase of red spotting. They did blood work and all. about a week later , they called me from the hospital telling me I had bacterial vaginosis and that my OB had to prescribe me some medicine. When I went into see my OB, I to...ld him what had happened and what they told me. He said that I didnt have anything and he had already checked me. He didnt even bother checking me again. He just said I was fine and sent me home. At 21 weeks, I went into for an ultrasound to find out what I was having. They discovered that my cervix looked like it was starting to efface. He said it might just be from the angle that it looked like that. He said I shouldnt worry about premature labor, and he sent me home. At 22 weeks pregnant, I started having really bad lower back pain..and some on my sides. I thought it was just because of the belly growing. Then at 23 weeks, I was rushed to the ER because I had very bad contractions and red mucus. 3 days later of trying to stop labor in the hospital, I delivered my son. They said it was due to an infection. Now, Im thinknig I should sue my OB for that? What do you think?
Update:No, my son didnt die. Thank God he is alive .but does have some medical problems. If the Dr had done his job, checked me, and given me my medicine nothing wouldve happened. I trusted him when he said I "didnt" have anything and I went into preterm labor. I will contact a lawyer

i would definitely be talking to a lawyer.. but lawsuits could last years.. you need to heal from this dramatic experience, im assuming you lost the baby, the longer the lawsuit carries on, the longer its going to take the healing process.

No, you can sue because he put your baby at risk and your baby is still at risk since he was born at 23 weeks. You have been so blessed with him surviving because the percentage rate is not high for 2nd trimester deliveries. Go talk to a lawyer because that doctor is in charge of your baby's health and your health. He lied to you and placed your baby at risk, that is enough for a lawsuit. I hope your baby grows strong and healthier everyday, otherwise, he's got ANOTHER lawsuit coming his way from you.
If your child was a still born, you would not get far. But because he is alive you are suffering from medical costs with him staying in the hospital. You can MOST DEF sue over that.
You can try but dont be surprised if you don't see anything from it. I talked to a lawyer about a medical neglect suit when I lost my son at 20 weeks, and was told that bc it didn't kill me or impair my body from conceiving that there was no point (one if the best in the state I live in) and that I wouldn't get anything. It's almost impossible to get medical suits to go through anymore bc if the insurance the drs have and all if the fine print on the paperwork you fill out. I even almost died from my situation, and nothing could be done. Good luck.
Sue. He should NOT be practicing medicine he is clearly not fit to do so. It sounds as though he put his pride first with the 'oh you don't have anything I already checked the ER is wrong'. First things first before you file you need to request ALL of your medical records from that doctor's office. You never know if he will try to remove the files or something when he gets the paperwork that he's being sued. You do need to consult with a lawyer about this.
